Scavr, LLC Terms of Service

1. Terms

By accessing scavr.app, scavr.com, or the Scavr mobile apps, you agree to be bound by these terms of service and all applicable laws and regulations, and you agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the service. The materials contained in Scavr are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to use Scavr for its intended purpose — creating and participating in scavenger hunts. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose beyond running your own hunts, or for any public display unrelated to the service;
    3. attempt to decompile or reverse engineer any software contained in Scavr;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or "mirror" the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Scavr, LLC at any time. Upon termination, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may delete your account at any time — see scavr.com/delete-account.html.

4. Content you submit

You retain ownership of the photos, videos, and other content you submit to Scavr. By submitting content you grant Scavr, LLC a limited license to store, display, and transmit that content as needed to operate the service — including showing it to the organizer of the hunt you submitted it to, for judging, and to your teammates.

You are responsible for the content you submit. Do not submit content that is unlawful, infringes someone else's rights, or that you do not have permission to share. We may remove content that violates these terms.

5. Disclaimer

  1. Scavr is provided on an 'as is' basis. Scavr, LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Further, Scavr, LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the service or otherwise relating to such materials or on any sites linked to this site.
  3. Scavenger hunts take place in the physical world. You are responsible for your own safety and for obeying all laws while participating. Scavr, LLC is not responsible for what happens during a hunt.

6. Limitations

In no event shall Scavr, LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Scavr, even if Scavr, LLC or a Scavr, LLC authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Accuracy of materials

The materials appearing in Scavr could include technical, typographical, or photographic errors. Scavr, LLC does not warrant that any of the materials are accurate, complete or current. Scavr, LLC may make changes to the materials at any time without notice. However Scavr, LLC does not make any commitment to update the materials.

8. Links

Scavr, LLC has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Scavr, LLC of the site. Use of any such linked website is at the user's own risk.

9. Modifications

Scavr, LLC may revise these terms of service at any time without notice. By using Scavr you are agreeing to be bound by the then current version of these terms of service.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Texas, United States, and you irrevocably submit to the exclusive jurisdiction of the courts located in Travis County, Texas.
